If you submitted 2 or 200 Jorns cases, we feel it is more effective for you to send this to your client!

Dear (Client)

If you have received a denial letter from the IRS regarding your claim for the Employee Retention Credit (ERC) for any Quarter 2020 or 2021, please follow the steps outlined below:  

Identify the Denial Letter

  • The letter will come from the "IRS Internal Revenue Service." 
  • While it's commonly sent out for 3rd Qt. 2021, we have seen it for any quarters in 2020 and 2021. 
  • The letter will state: "WE CAN'T ALLOW YOUR CLAIM" and will indicate that your ERC claim for the specified period has been disallowed. 

What to Do Next

  •  Scan all pages of the IRS letter (do not omit any pages, even if they seem unimportant). 
  • Email all scanned pages to faziz@jornstax.com as soon as possible. 
  • In your email, please indicate whether the letter was received via Certified Mail or Regular Mail. 

What Happens Next?

  • Fida Aziz will immediately forward the documents to Jorns' Tax Attorneys. 
  • Jorns' attorneys will begin the process of appealing the IRS decision. 

Required Actions from You!

  •  You will receive an agreement to sign, authorizing Jorns' Tax Attorneys to represent you and contact the IRS regarding this matter. 
  • Important: Signing and returning this agreement is crucial to move forward with the appeal process. 
  • A $150 fee is required to proceed with the appeal. 
  • Note: The $150 fee is not due until 90 days after the appeal is filed. Extenuating circumstances may be considered if needed.

  •   By following these steps, Jorns will be able to assist in appealing the IRS denial and help resolve your ERC claim. 
  • Thank you for your prompt attention to this matter! 

 When you receive checks from IRS 

  •    As you begin receiving your checks from the IRS, please scan and email a copy to ar@jornstax.com  
  •  This allows Jorns accounting to finalize the invoice for those specific checks.
  •  Additionally, to avoid any late fees, kindly remit payment as you receive your Final Invoice. 
  •  Please be aware that the IRS issues ERC refund checks per quarter.

  • Below are Instructions for Contacting the IRS Regarding Your ERC Claim (2020 & 2021 Quarters):


Clients may contact the IRS directly to inquire about their Employee Retention Credit (ERC) claim status. Below are the recommended steps:

Call the IRS: Use the dedicated line at 800-829-4933...Note: It's best to call early in the day for shorter wait times.   

Follow the prompts: Option 1, then Option 3...Once connected with a representative:


  • Clearly state that you are calling about the Employee Retention Credit (ERC) program.
  • Specify the exact quarters you're inquiring about: 2020: Q2, Q3, and Q4 - 2021: Q1, Q2, and Q3
  • Ask if all these quarters have been assigned to an IRS Agent
  • Provide the business information for verification:
  • Business name
  • Employer Identification Number (EIN)
  • Business address on file with the IRS
  • Establish your authority:
  • Introduce yourself and state your title
  • Inform the agent that you are legally authorized to bind the company and speak on its behalf
  • This confirms your authority and allows the agent to access and discuss the file
  • Request detailed status updates:
  • Ask the representative to review the status of each specific quarter where you have not yet received information.
  • If the agent mentions needing IRS Form 8821, clarify that as an officer/owner authorized to bind the company, Form 8821 is not required
  • Encourage a thorough review:
  • Politely request that the agent dig deeper into the file to provide all available updates.

                                 Remember, it is the IRS...expect long hold times...Be Nice Not Nasty...

……, I just spoke to………………. who stated that under your advice he should try to negotiate the interest that we are retaining to compensate our attorney since it is a bonus fee for us. By making these false claims, you are violating your affiliate contract, and any "negotiations" will be deducted from your referral commission. The interest retained is being used to compensate our attorneys, and obviously since your client is holding a check, our expediting services were successful. Also, the only reason why we are even talking about interest is because our attorneys were able to demand the IRS to add this on top of their ERC amounts received. Don, make sure all your reps understand they will be violating their affiliate agreements if this continues to happen, thanks
